Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you", "User") and Dirtybunny ("we", "us", "our"), the operator of dirtybunny.io (the "Service"). By creating an account, purchasing credits, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use the Service.

You must be at least 18 years old, or the age of majority in your jurisdiction (whichever is greater), to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into this agreement.

You must not use the Service if you are barred from doing so under applicable law.

Dirtybunny provides AI-powered tools for image generation, image editing, image merging, face swapping, video generation, and related creative workflows. The Service relies on third-party AI model providers (including, without limitation, fal.ai and the underlying model providers it routes to) to fulfill generation requests.

Features, models, pricing, and credit costs may change at any time without prior notice. We do not guarantee the continued availability of any specific model or feature.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@dirtybunny.io of any unauthorized use of your account.

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct harmful to the Service, other users, or third parties.

The Service is offered on a pay-as-you-go credit basis and may also offer subscription plans. Credit costs for each generation are displayed before the action is initiated.

All payments are processed by Stripe, Inc. ("Stripe"). By submitting payment information, you agree to Stripe's terms and privacy policy, available at https://stripe.com/legal. We do not store full payment card numbers; that data is handled directly by Stripe.

Credits are non-refundable except where required by applicable law or where a generation fails due to a technical error on our side (in which case credits are automatically refunded to your account). Credits have no monetary value, cannot be transferred, sold, or redeemed for cash, and may expire if your account is inactive for an extended period or if these Terms are terminated.

Subscription plans renew automatically until cancelled. You may cancel at any time from your account; cancellation takes effect at the end of the current billing period and prior charges are not refundable.

Disputed charges or chargebacks initiated without first contacting us at support@dirtybunny.io may result in immediate suspension of your account.

When you submit a prompt, image, or other input, that input is transmitted to one or more third-party AI providers (including fal.ai) for processing. Your use of the Service is therefore also subject to the terms, acceptable-use policies, and privacy practices of those providers, including but not limited to fal.ai's Terms of Service available at https://fal.ai/legal/terms-of-service and the terms of the underlying model providers (e.g., Google, Kling).

We do not control and are not responsible for the output, availability, latency, or behavior of these third-party providers. Outputs may vary, may be inaccurate, and may not match your expectations.

You agree not to submit any input that violates the policies of any upstream AI provider. Violations may result in your request being rejected, your account being suspended, or credits being forfeited.

"User Content" means any prompts, images, videos, audio, text, or other materials you upload, submit, or generate through the Service. You retain ownership of the User Content you upload, subject to the rights you grant below.

You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, and process your User Content solely as needed to operate, maintain, and improve the Service, to provide it to you, and to comply with legal obligations.

Subject to applicable law and the terms of the underlying model providers, you may use generated outputs for personal and commercial purposes. However, you acknowledge that (a) AI-generated outputs may not be eligible for copyright protection in some jurisdictions, (b) similar or identical outputs may be generated for other users, and (c) we make no warranty that any output is original, non-infringing, or fit for any particular purpose.

You agree NOT to use the Service to create, upload, generate, or distribute content that:

(a) depicts, describes, or sexualizes minors in any way (including CSAM, simulated or real);

(b) depicts non-consensual sexual content, intimate imagery of identifiable individuals without their consent, or content intended to harass, defame, threaten, dox, or impersonate any person;

(c) promotes terrorism, mass violence, self-harm, or illegal activity;

(d) infringes any third party's intellectual property, publicity, privacy, or other rights;

(e) contains malware, exploits, or attempts to interfere with the Service's infrastructure, rate limits, or security;

(f) is used to create deceptive deepfakes, election misinformation, fraudulent identity documents, or financial scams;

(g) violates any applicable law, regulation, or third-party policy (including the policies of fal.ai or any underlying model provider).

For face swap, image edit, and similar features that use a person's likeness, you represent and warrant that you have the necessary rights, permissions, and consents from every identifiable person depicted in the input images. You are solely responsible for obtaining and documenting such consent.

We reserve the right, but have no obligation, to monitor, review, or remove any User Content and to suspend or terminate accounts that violate this policy, without refund.

The Service, including its software, design, logos, and branding, is owned by Dirtybunny and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

You may not copy, modify, reverse-engineer, decompile, scrape, or create derivative works of the Service except as permitted by applicable law.

Our handling of personal data is described in our Privacy Policy. By using the Service, you consent to the collection and use of your data as described there. Inputs you submit may be transmitted to third-party AI providers as described in Section 6.

THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION.

WE DO NOT WARRANT THAT GENERATED OUTPUTS WILL BE ACCURATE, SAFE, ORIGINAL, NON-INFRINGING, OR SUITABLE FOR ANY PURPOSE. YOU USE OUTPUTS AT YOUR OWN RISK AND ARE RESPONSIBLE FOR REVIEWING THEM BEFORE USE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIRTYBUNNY AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

You agree to defend, indemnify, and hold harmless Dirtybunny and its affiliates from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your User Content or any input you submit, (c) your violation of these Terms or any law, or (d) your violation of any third party's rights, including the policies of any upstream AI provider.

You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, for any reason, including suspected violation of these Terms. Upon termination, your right to use the Service ends immediately and any unused credits may be forfeited.

Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, indemnity, and governing law) will survive.

We may modify the Service or these Terms at any time. Material changes will be communicated by updating the "Effective Date" above and, where appropriate, by additional notice. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws principles. You and Dirtybunny agree to submit to the exclusive jurisdiction of the courts located in the State of New York, USA for the resolution of any disputes, except where prohibited by applicable law.

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
